Logical Arts LLC Terms of Service

These terms of service (“Terms”) cover your use and access to our combined SecureDocMan services, and websites (“The Service”). Logical Arts, LLC (“Logical Arts”) is the company that operates The Service. Our Privacy Policy explains how we collect and use your information while our Acceptable Use Policy outlines your responsibilities when using our Services. By using our Services, you’re agreeing to be bound by these Terms, and to review our Privacy and Acceptable Use policies. If you’re using our Services for an organization, you’re agreeing to these Terms on behalf of that organization.
Payments
Payment for The Service is required based on your anniversary date and can be for various terms lengths including but not limited to monthly and annually. If you are delinquent with your payment we reserve the right to suspend or terminate your account after reasonable collection attempts have been exhausted. It is your responsibility to keep your contact information up-to-date to reduce the chance of mis-communications.
Overages
Your plan will include a certain amount of storage and data usage. Anything above the included limits will be charged on a monthly basis at the end of each month.
Refunds
We do not issue refunds for paid Services but you may cancel at any time.
Pricing
While we typically do not increase fees on existing customers it could happen in extreme circumstances. We will contact you in advance if that were to ever happen.
“As Is” Service
SecureDocMan is an As-Is Service. We try to provide the best service possible but sometimes things happen, stuff breaks. TO THE FULLEST EXTENT PERMITTED BY LAW, LOGICAL ARTS AND ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. THE SERVICES ARE PROVIDED “AS IS.” WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EXCEPT FOR ANY LIABILITY FOR LOGICAL ARTS OR ITS AFFILIATES’ FRAUD, FRAUDULENT MISREPRESENTATION, OR GROSS NEGLIGENCE, IN NO EVENT WILL LOGICAL ARTS, ITS AFFILIATES, SUPPLIERS OR DISTRIBUTORS BE LIABLE FOR:
(A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR
(B) ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS, REGARDLESS OF LEGAL THEORY.
THIS WILL BE REGARDLESS OF WHETHER OR NOT LOGICAL ARTS OR ANY OF ITS AFFILIATES HAVE BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
ADDITIONALLY, LOGICAL ARTS, ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS WILL NOT BE LIABLE FOR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES FOR MORE THAN THE GREATER OF $20 OR THE AMOUNTS PAID BY YOU TO LOGICAL ARTS FOR THE PAST 12 MONTHS OF THE SERVICES IN QUESTION.
Resolving Disputes
Please work with us if you encounter an issue. Before filing any sort of claim against Logical Arts you are agreeing to try and resolve your issue by contacting support at securedocman dot com. If we cannot resolve the issue in a timely manner we may have to go through other channels such as formal proceedings. You and Logical Arts agree that any claims will be handled according to federal or state courts in Sacramento County, California subject to local arbitration laws which you agree to adhere to. These Terms will be governed by California law except for its conflicts of laws principles, unless otherwise required by a mandatory law of any other jurisdiction.
Copyright
We respect the intellectual property of others and ask that you do too. We respond to notices of alleged copyright infringement if they comply with the law, and such notices should be reported using our Copyright Policy. We reserve the right to delete or disable content alleged to be infringing and terminate accounts of repeat infringing. Modifications
We may at times update The Terms. We will present the most recent version of The Terms and notify you via email to your main account email. By continuing to use The Service after the modification you are agreeing to be bound by the new terms.
